Este estudio esboza un mapa evolutivo de la administración judicial en Chile en el siglo XIX. Busca tanto localizar los distintos juzgados de la República como entender las lógicas que los dinamizaron. Abarca de 1824 a 1875, fechas que corresponden respectivamente al Reglamento de Administración de Justicia y a la Ley de Organización y Atribuciones de los Tribunales, dos hitos en la construcción del aparato institucional. Cruzando distintas fuentes primarias como los Anuarios Estadísticos, las descripciones geográficas de la época, los documentos oficiales emitidos por el Ministerio de Justicia y sus tribunales y los textos de leyes, abordamos la administración judicial territorial no tanto como “debía ser” sino “como era realmente”: por lo tanto, confrontamos las instituciones con su implementación.
This study outlines the evolution of the map of the judicial administration in XIXth century Chile. It tries to understand the dynamics of these courts by localizing them, covering from 1824 to 1875, a period shaped by the “Rules of Procedure for the Administration of Justice” and by the “Law of Organization and Attributions of the Courts”, two milestones in this institutional building process. By considering different primary sources, such as statistical yearbooks, geographical descriptions of the period, official documents produced by the Ministry of Justice and the courts, and legal texts, we can see the territorial aspect of judicial administration not so much as “it should have been” but “as it really was”, and confront institutions to their implementation.
Cette étude esquisse un plan évolutif de l’administration judiciaire du Chili au XIXe siècle. Il s’agit aussi bien de localiser les différents tribunaux de la République que de comprendre leurs dynamiques. La période retenue est celle de 1824 à 1875, entre le Règlement de l’Administration de la justice et la Loi d’Organisation et d’Attributions des Tribunaux, deux points forts de la construction de l’appareil institutionnel. Croisant différentes sources primaires, telles les Annuaires statistiques, les descriptions géographiques de l’époque, les documents officiels du Ministère de la Justice et ses tribunaux, ainsi que les textes de lois, il s’agit d’aborder l’administration judiciaire territoriale non comme un devoir-être mais telle qu’elle était réellement: nous confrontons les institutions à leur mise en œuvre.
